Postal Service Loses Again on Issue Of Casual Employm,ent In Shrewsbury P&DC

The Union Proved that The Postal Service Violated the National Agreement over a Two Week Period by employing casuals in lieu of career employees in a representative case in Shrewsbury P&DC.

The Union proved in a two-week representative case that management violated the provisions of article 7.1 of the national agrement when they employed casuals instead of career employees in the shrewsbury P&DC.

Arbitrator Joshua Javits ruled that the Postal Service had indeed violated the Casuals in lieu of career employees provision of the national agreement when they stated that they were employing casuals to cover for long term absences with casuals instead of hiring career employees and ruled that the postal service must negotiate a financial settlement with the union in the subject case and all cases attached to it in the 'representative greivance process outlined in article 15 of the grievance procedure.

Because the case is a "representative" case, the case holds jurisdiction over all cases held awaiting outcome of the "rep" case and the postal service must come to finanical settlement on all cases held in abeyance pending resolution of the "rep" case. 

Management tried unsuccessfully at the hearing to make the union put on all of the cases that were "repped" to the "representative" grievance, but were rebuffed at arbitration.  This was but one of the dozens of dirty tricks pulled by management at the hearing but all were to no avail, as the Union once again was victorious in Shrewsbury on the,  "In Lieu Of" Issue.

Congratulations to all of the Stewards and Officers of the Shrewsbury Branch # 127 and to Branch President Craig Lauzon for all of the long, hard hours of documentation and faith it takes to continually beat back the Postal Service from hiring Casuals instead of career Mail Handlers!!  It comes from hard work and a little bit of faith that the system does work if you continue to work it!  Great job!
